Legal and fiduciary fees in estate and fiduciary litigation are often challenged and/or scrutinized by the Probate Court. This presentation will focus on the standards and procedure for obtaining fees – whether legal fees, fiduciary fees, or fees earned by court appointed attorneys. The panel will cover the standard for fees, when the fees can be paid without court permission, challenges to fees contained in fiduciary accounts, and the court’s statutory ability to reallocate fees in litigation. The panel will provide examples of successful motions for fees and common forms, and present the perspective of the court when evaluating such requests.
