First Prompt Pay Act Case Argued Before the SJC by Conn Kavanaugh Litigation Partner Andrew Dennington

The SJC case is featured in the February 16, 2024 issue of Mass Lawyers Weekly.

In the article, Dennington said his hope for the Business Interiors decision is that the SJC will reaffirm Tocci’s central holding, which is that the Prompt Pay Act “means what it says and says what it means.”

“The contractor seems to be arguing that there are some unwritten exceptions to the PPA. I’m hopeful that the court will reject that attempt to find unwritten exceptions to the reject-or-pay scheme that’s set forth in the statute,” said Dennington.
